Please read the Terms & Conditions carefully as your use of the website indicates that you are agreeing to follow and be bound by the Terms & Conditions below. If you do not agree with our Terms & Conditions please do not access our site. up2uprint.com reserves the right to change or modify the Terms & Conditions at any time without prior acknowledgment to you and your continued access of the website implies agreement to the new Terms & Conditions set forth.
up2uprint.com , its content, logos and trademarks are all protected by copyright laws of the United States. None of these components are to be replicated, copied, modified, or distributed in any way without the written consent of up2uprint.com up2u print Inc. is also not to be held accountable for the use of illegal copyright materials on the part of clients as we do not check submitted content for copyright violations.
You agree to indemnify and hold up2uprint.com and its affiliates harmless from any damages or expenses (including attorney fees) thought to have arisen due to the use of this website and/or a breach of the Terms & Conditions.
Up2u Print Inc does not warrant that all information found on the site is 100% accurate or error-free at all times or that the products and services available on the site will be delivered without delays or interruption. We cannot guarantee that our services and products will meet all your requirements. We also cannot guarantee that our website will stay free of malicious viruses or other software components and all downloads and website activity will be performed at the user’s discretion. Up2u Print Inc. will not be held liable for any amount more than the total amount of your purchase at the time and date of purchase. This includes consequential damages (special, incidental, indirect, direct, punitive) or loses of any kind that may arise from the use and/or misuse of the site or the inability to access the site in part or in whole. In the event that we have not received payment, we reserve the right to hold your purchase until the balance is paid.
We reserve the right to refuse service to any party for any reason we deem fit.
You, the user, upholds to create an account using a real name and by providing accurate information about your company and contact information. It is the user’s responsibility to check the accuracy of all account information (addresses, phone numbers, orders, credit card information, etc.) and to keep all information up to date and accurate. up2uprint.com is unaccountable for any errors that arise from account information/order inaccuracies. The user is also responsible for account access and up2uprint.com will not be liable for password and account access issues. You shall not provide fraudulent information or make fraudulent requests/orders when using up2uprint.com. Our products and services are not to be used in unauthorized ways including, but not limited to, spam or any form of solicitation. By using this site, you are also agreeing that you are of sufficient legal age to enter into legal obligations in the event of incurring liabilities. You may not use robots or any automated processes to access the website directly or indirectly.
All content (text, photography, data, graphics, etc.) provided to up2uprint.com is the sole responsibility of the user, the party that provided the content. The user agrees by accessing the website that all content transmitted through up2uprint.com is deemed acceptable and complies with local rules in regards to online conduct. Because up2uprint.com does not control the content that is transmitted through the website, we are not to be held liable for any content that you are exposed to that you may find objectionable under any circumstances. We are also to be held unaccountable for how the user uses content/information taken from up2uprint.com. The content and media you supply up2uprint.com will not be returned so do not send original copies in the event you would like them back. up2uprint.com also reserves the right to remove content from the website at our own discretion and to keep and disclose content, in good faith, for legal purposes or when deemed necessary.
Up2u Print Inc. reserves the right to refuse to print objectionable content. In this event, we will provide a refund minus 10% for processing fees. If you have questions on whether we will accept your content, please contact our Customer Service representatives at 1.650.494.6900. Content deemed objectionable and inappropriate is, but not limited to, content containing any form of pornography, lewd/indecent conduct, threats, libel, blackmail, treason or intellectual property violations.
OFFICE HOURS & HOLIDAYS
Office hours are Monday – Friday from 10:00AM – 4:00PM Pacific Standard Time, excluding holidays. Weekends are excluded from our Turnaround Time.
Will Call Hours are Monday – Friday from 10:00AM – 4:00PM. Express Orders, same day service store pick-up or delivery will be ready between 2:00PM – 11:00PM on the date they are due. Please contact our Customer Service representatives at 1.650.494.6900 for confirmation.
All operations are closed on the following business holidays. These holidays are excluded from our Turnaround Time.
New Year’s Day
Thanksgiving Day, and the Friday following Thanksgiving
UPLOADING ARTWORK FILES AND GRAPHICS
All artwork files submitted to up2uprint.com must be submitted in the CMYK format, except for spot colors. If we receive a file not in the CMYK format we will format the file correctly, but we will not be held accountable for any shifts in colors that may occur. We suggest a minimum resolution of 300 dpi for all graphics and images at the print size. If we do not receive a file with the proper resolution, we will not be held responsible for any blurred, fuzzy images that may result.
If we receive artwork that needs to be altered either technically or in terms of design, we will charge the client $75/hour with a $25 minimum charge.
PROOFS AND COLOR ACCURACY
The user alone is responsible for the accuracy of their artwork file. It is the responsibility of the user to review the final artwork file before approving the order for printing. For orders designated to Print Without Proof, no changes of any kind or cancellations can be made once the order is processed and ready to print and the file provided to us is deemed accurate. up2uprint.com will not be liable for any inaccuracies in the design file and any errors in the printed product relating to, but not limited to, typographical errors, graphics, product finish size, scoring, folding and die-cutting. For Hard Copy Proofs, regardless of the paper selected for your finished product, we will provide you with a Hard Copy Proof printed on G7 certified proofing material. This will cause slight variations in color when your product is printed on your selected paper material. This is a common, accepted practice within the printing industry. PDF proofs will not reproduce colors accurately but will provide you with a look at the final design layout, placement and text accuracy so we will not be held accountable for the final appearance of color. Once Hard Copy Proofs and PDF Proofs are approved by the client, no further changes can be made to the order.
If you do not approve the proof we provide you and you need to make changes to your design, we will charge a $10 fee to submit your new artwork file. If you would like to order a new proof we will charge an additional $5 for a PDF proof. Please contact our Customer Service representatives for a new Hard Copy Proof.
Coatings will also cause shifts in color accuracy. Up2uprint.com will not be held liable for shifts in color resulting from coating, paper stock, etc.
Because toner sits on the surface of the paper, solid colors that sit above any folds will crack.
Users may cancel an order with a 10% (of your total amount) penalty before a proof is approved; this excludes orders designated to Print Without Proof. If your order is to Print Without Proof or if your proof has already been approved we will not provide a refund for cancelled orders.
All prices on up2uprint.com are in United State’s Dollars. Payments must be received at the time of order in full in order to begin processing your order. The user agrees to provide and keep on file a current, valid credit card that they are authorized to use. In the event that the credit card becomes invalid, the user will provide up2uprint.com with a new valid, current credit card. If a charge on your credit card is rejected, we reserve the right to cancel your order.
The user agrees that orders are delivered in full when the delivered quantity is within 5% over or under the ordered quantity.
Turnaround times do not include shipping time and do not begin until proofs have been approved, unless the order was designated to Print Without Proof. up2uprint.com will not be liable for delays resulting from an unapproved proof. Proof approvals must be submitted in a written form, verbal approvals will not be honored. Weekends and Holidays are not accounted for when calculating turnaround times.
For Next Day delivery or (Same Day Service Store Pick-up or Local Delivery of Digital printing), we must have an "approved proof" or "Print Without Proof" artwork file submitted to us by 10:00AM PST. The Next Day orders will be ready for pick up or delivery the next business day by 8:00PM PST. The Same Day Service Store Pick-up or Local Delivery of Digital printing orders will be ready for pick up or delivery the same business day by 11:00PM PST. If the order is not ready and processed by 10:00AM, we will treat the order as being received the next business day. For all other turnaround times, we must have an approved proof or Print Without Proof artwork PDF file submitted to us by 1:00PM PST. Your order should be ready for pick up or delivery by calculating the turnaround time you selected when placing your order on business days, Turnaround times do not include shipping or Transit times. If the order is not ready and processed by 1:00PM PST., we will treat the order as being received the next business day.
Unexpected delays and equipment failures are common in the printing industry and are sometimes out of our control, but we will do our due diligence to meet your specified deadline. When these delays occur and they lead to missed deadlines on our part, we will provide a refund in the amount of the difference between the turnaround time chosen and the turnaround time met. However, if you had selected the slowest turnaround time, no refund will be given.
Up2u Print Inc. employs multiple paper stock sources and paper mills in order to provide you with the best quality and prices. We cannot be held accountable for changes to paper stocks made by our sources. These changes may result in slight shifts in the quality of the paper and/or order even when reordering a previous job.
RETURNS & REFUNDS
All sales are final. If the error made to your order can be verified to have been made on up2uprint.com’s part, we will reprint your order at no cost to you. Any mistakes discovered pertaining to the order must be reported to up2uprint.com within 10 days of your order’s completion. In order to receive the replacement order, your original, defective order must be returned in full within 15 days of delivery at your own expense. All charges relating to expedited orders are non-refundable.
up2uprint.com will not be held responsible for lost or undelivered mail or any consequential damages. We will have proof of a mailing statement that can be made available to you upon request.
Your mailing list will not be sold or distributed to a 3rd party or be used for any other reason than for your mailing. We may archive your list, but will not be responsible for having your list readily available to you in the event of a system failure.
SHIPPING AND SHIPPING ERRORS
up2u print Inc. will do its due diligence in avoiding delays to your order shipment; however, we will not be liable for any damages resulting from delayed production or shipping. The user acknowledges that delivery dates are estimated and cannot be guaranteed. up2uprint.com cannot be held responsible for delays due to circumstances beyond our control. Order cancellations may not be made due to delayed production or shipping and only rush fees may be refunded due to delays resulting from technical difficulties.
up2uprint.com will not be held accountable for 3rd party errors including, but not limited to, delays, omission, and damage. You may only file a claim within 30 days from order shipment. If the delivery address is incorrect, up2uprint.com will reship the order with an additional shipping fee.
In order to be tax exempt you must file a re-sale certificate with up2u print Inc., have your order mailed from our facility while having a Printed Sales Message Sales Tax Exemption Certificate for the order, or have your order shipped to a mail house along with a Printed Sales Message Sales Tax Exemption Certificate with the order number written on it.
Up2u Print Inc. is located in Palo Alto, CA and any legal action or proceeding in regards to the use of up2uprint.com will take place in Palo Alto, CA, regardless of where you accessed the site. You agree to comply with the jurisdiction of Palo Alto, CA and venue of the courts.
